Advice for a driver stopped by an officer who suspects them of drinking.
1. First and foremost, remain calm and respectful. When an officer stops a car, he is generally on the lookout to see how that person reacts to determine whether to take the next step and investigate a DUI/DWI. Someone who is nervous, argumentative, jumpy or loud is much more likely to be investigated than someone who is calm and respectful. Do not argue, plead or volunteer information. Simply respond to questions in a calm respectful manner such as "yes sir" and "no ma'am."
2. If asked, do not admit to drinking. Statements made to an officer in the course of investigation are admissible in subsequent trials. Statements such as "I only had 6 beers" will not help and will only make it easier for the state to prove its case.
3.If pressed, state that you are exercising your Miranda rights not to make any statement without the presence of counsel.
4. If asked to perform sobriety tests, make a judgment about your ability to pass them. If there is any question in your mind about your ability to pass sobriety tests, simply refuse to do them.
5. You may be taken to the department and asked to take a breathalyzer test. Whether to "blow" or not depends on a number of factors.
a. In North Carolina, refusing to take a breathalyzer test results in an automatic suspension of your license for 1 year. For this reason, if you need to drive for work, you probably should blow. Even if convicted of DUI, a limited driving privilege is possible if you have not been convicted of a DWI within 7 years, meaning you can drive to work, school etc.
b. If you have prior DWI's within 7 years, you probably should not blow, unless you are confident the result will be below .08
c. If you do not blow, in North Carolina, officers can require blood be drawn, with or without your permission.
d.The law allows you 30 minutes to get a witness to view your breathalyzer. Absolutely try to get a witness there.
